The following general terms and conditions of sale (General Conditions) rule the sale of the products (Products) marketed by Le Malindine di Ferrè Elena with registered office in Italy 20851 Lissone – Via Francesco Ferrucci, 31.

Online sales contracts for Products by Le Malindine di Ferrè Elena to its Customers via telephone, fax, internet, and email are governed by these General Conditions, which are deemed accepted by the Customer and form an integral part of every purchase order for the Products (Order/s).

1. Orders

1.1 – The sale of Products takes place remotely, using the following methods. Orders may be submitted by Customers to Le Malindine via the internet (online transaction or email). Acceptance of these General Conditions, in the case of online purchases through the website, www.lemalindine.com is confirmed by the Customer's selection of the appropriate checkbox on the order page, which explicitly states, "I accept the general terms and conditions of sale of " Le Malindine”.

1.2 – Each Order constitutes the Customer's contractual acceptance, and the sale is considered concluded upon receipt of the Order Form by Le Malindineat the indicated office. The validity of the order is subject to acceptance of Le Malindine. Le Malindine reserves the right not to execute incomplete orders or orders not signed by the Customer or specifically approved in writing pursuant to articles 1341 and 1342 of the Civil Code.

1.3 – In case of non-fulfillment of the Order by Le Malindine due to the unavailability, even temporarily, of the Products Le Malindine will inform the Customer and refund any amounts paid for such Products. The Customer shall not be entitled to any further refund, compensation, or damages of any kind.

1.4 - Orders for materials that have already left our warehouse cannot be cancelled or changed. The Customer must follow the return procedure

2. Prices

2.1 – The prices of the Products published include VAT. VAT is calculated based on the currently applicable rate. Le Malindine reserves the right to apply any different rates according to the provisions of the law in force on the date of the Order.

3. Payment and Products delivery

3.1 - Payment for the Products can be made

- via credit card, processed online through the payment gateway managed by Stripe;

- via PayPal account or by credit card through PayPal

- via bank transfer

3.2 - Delivery is carried out via courier (Carrier) and is considered complete once the Products reach the closest point to the address specified by the Customer in the Order that is accessible by the Carrier. Le Malindine offers the following delivery method:

- International Express Delivery: via express courier. Orders will be processed within 12/24 hours. The service includes delivery to the Customer's address at street level (not to the floor).

- Pick up at our show room in Italy - Lissone (MB) upon appointment : Le Malindine di Ferrè Elena – Via Francesco Ferrucci 31 – 20851 Lissone (MB)

The goods are shipped within 12/24 hours of receiving the order. Once shipped, the goods travel with third-party couriers who complete delivery on average within 3/5 working days (depending on the final destination). These terms are merely indicative and non-binding in nature. Le Malindine is in no way responsible for direct or indirect losses resulting from the fact that the Carrier has delivered the Products after the delivery date indicated in the General Conditions.

IMPORTANT: Deliveries are made on working days, from Monday to Friday, excluding holidays, from 9.00 to 17.00.

4. Product Features

4.1 - Le Malindine reserves the right to modify, without notice, the characteristics of its production based on the continuous evolution of the design.

4.2 – The Customer is responsible for choosing the Products ordered and for the correspondence and conformity of the specifications indicated by Le Malindine.

4.3 – Complaints against any defective or missing products must be sent to the Le Malindine headquarters within 8 days of receipt of the Products.

5. International Return Policy

5.1 - We are glad to offer you a full refund on all goods returned to us in resalable condition within 14 days of purchase.
To exercise this right, the customer must send Le Malindine a communication to this effect, within 8 working days from the date of receipt of the goods. This communication must be sent to: elena@lemalindine.com ---

Purchases made outside Italy may be subject to customs and duty fees which you, the customer, is responsible for and must pay. You are responsible for the postage cost to return your items. Regrettably, delivery charges are non-refundable unless your order is incorrect or faulty.

5.2 - Please carefully check your items when they arrive to ensure you are completely satisfied. Should you receive a faulty/damaged item, please email us at elena@lemalindine.com to let us know and then follow the Returns Procedure above.

5.3 – The right of withdrawal is however subject to the following conditions:

– the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
– the purchased good must be intact and returned in the original packaging, complete in all its parts (including the packaging/bag of the good).

5.4 – Without prejudice to the conditions referred to in point 5.3, Le Malindine will refund the customer the entire amount already paid, within 14 days of receipt of the product through the payment method (where possible) used by the Customer at the time of the order.

5.5 – The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Le Malindine ascertains:

– the lack of the original external packaging;
– the absence of integral elements of the product;
– damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Le Malindine will return the purchased goods to the sender, charging the shipping costs to the sender.

6. Privacy

6.1 – The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer and will under no circumstances and for any reason be transferred to third parties, nor will they be used to send advertising material without prior notice consent of the owner. Le Malindine guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 06.30.03. The data controller is Le Malindine di Ferre' Elena.

7. Jurisdiction

7.1 – For any dispute the competent court is that of Monza (Italy).
